All payments are non-refundable if cancelled by you. No shoot will be booked until retainer is received. Rescheduling request must be in writing or completed via the link sent in your initial booking confirmation email and must be received at least 24hrs prior to shoot time. You are allowed only 1 reschedule are and shoot must take place within 30 days of the original photoshoot date. After that day, the retainer and any other money paid is forfeited. Any attempt to reschedule again, Will result in your appointment being cancel and you will need to rebook again for the desire date. Usage Rights: The client is obtaining images for PERSONAL use ONLY and shall not sell nor use images for any commercial purposes without the photographer's consent. Photoshoot types are NON interchangeable. For example, you can NOT book a 'Head Shot Shoot' or 'Portrait Shoot' session if you're actually doing a photoshoot for your brand or business. BluEyes LLC reserves the sole right to cancel the session WITHOUT a REFUND and/or withhold edited images if any such activity occurs. Unlimited COMMERCIAL usage rights can be purchased for an additional fee for non 'Businesses and Brands' packages. Changes to the session are not permitted the day of the shoot. If you need to make changes please email me. Your photoshoot session starts and ENDS at the time you selected, not your arrival time. This time includes setup, look changes and gathering of your items for departure, so book your session time 'ADD ONs' accordingly. Wardrobe and props are NOT provided unless stated otherwise in package details. Please feel free to bring any and all props that you would like to incorporate into your photoshoot. On-location is not included in pricing unless stated in the description or selected as an 'ADD ON'. If 'On-Location' is selected, BluEyes LLC. does NOT perform photoshoots sessions outdoors in the rain, extreme cold (below 45 degrees) or extreme heat (above 90 degrees). It is your duty to check the weather in advance and make changes to your session time, date or location. Up to 2 reschedules are allowed and shoot must take place within 30 days of the original photoshoot date. After that day, the retainer and any other monies paid is forfeited. It is your duty to ensure that you have FULL permission to be photographed at the location. BluEyes LLC will show up to the location at least 10 minutes prior to the scheduled session time. If you are more than 20 minutes late, BluEyes LLC will depart and your retainer will be forfeited. You are fully responsible for any guest, including children, that accompany you to your photoshoot. Up-to 2 additional adults are allowed to accompany you. Any additional people will NOT be permitted. Disregarding this rule will result in the TERMINATION of the photoshoot session without a refund. You will be responsible for the reimbursement for any damages caused by you and/or your guest. Any photoshoot that includes sprinkles, confetti, glitter, etc. must be cleaned up by the client and will require at least 30 minutes of additional time. If not cleaned you will be charged an additional $50 cleaning fee. There will be an additional $30 ‘backdrop fee’ for ‘Cake Smash’ or similar photoshoots using icing, cake, syrup, etc. that will stain or damage the colored paper backdrop. All additional fees are due BEFORE the editing process starts and must be paid within 15 days after shoot date. After that time all edits and all monies received are forfeited. All images sent via "Pass" or "PicTime" will have a watermark (PROOF) on them and may NOT BE POSTED OR SHARED on social media under any circumstances. Any images posted by you or someone else will result in the forfeiture of edited images and any monies received for edits. Edited images can take at least 7-14 business days after selection is received and payment is made. You can also choose a rush edit option after your photoshoot. 7 business days $50, 4 business days $75, 2 business days $100 or same day $150 Any request for changes made on any retouched/out of camera images will be denied due to you already possessing the image that was sent. BluEyes LLC does not make changes on edited photos do to having creative control over the image. Unless otherwise specified, it is understood that any and all rights to proofs, edits, final, sample prints, or digital media, thereof (hereinafter referred to as “video” and/or “photos”) shall remain to be used for advertising, display or any other purposes thought proper by BluEyes LLC. By sending your retainer you are agreeing to these terms.
